§1 About these Terms

These Terms of Service ("Terms") form a contract between you and Hong Chae-eun, sole proprietor (d/b/a "NYXA") ("we", "us"). They govern your access to and use of the NYXA mobile-web product at trynyxa.com (the "Service").

Use of NYXA does not require an account. By entering your birth details and (for paid reports) your email, you agree to these Terms.

By purchasing a report or clicking the consent checkboxes at checkout, you accept these Terms and the Privacy Policy.

If you do not accept these Terms, do not purchase or use the Service.

§2 What the Service is

NYXA computes a Korean four-pillar (BaZi) day-pillar report from your birth data using the Late-Zi method with true solar time correction, and delivers a 13-chapter English-language self-discovery report tailored to that day-pillar and your selected gender variant (Female or Male).

NYXA offers a free preview report and a paid Premium Report. The free preview does not require email. The Premium Report requires email so we can deliver the report link and receipt.

The report is for entertainment and self-reflection purposes only. It is not medical, legal, financial, psychological, or other professional advice, and it is not a substitute for a qualified professional.

The report does not promise specific outcomes — jobs, partners, dates, money, or health events — and is descriptive only, not forward-looking.

§3 Eligibility

You may use the Service only if:

  • You are 16 years of age or older in the EU/EEA, or
  • You are 13 years of age or older in the United States, or
  • You are 14 years of age or older in the Republic of Korea (younger users may only use the Service through a parent / legal guardian who has provided verifiable consent), and
  • You have the legal capacity to enter into a binding agreement in your jurisdiction, and
  • Your use does not violate any law applicable to you.

§4 Wellness disclaimer

The Service is a self-reflection product, not a healthcare, legal, financial, or professional-advice product. By using the Service you acknowledge:

  1. The report is not medical advice. It does not diagnose, treat, cure, or prevent any condition. If you have a medical concern, consult a licensed healthcare professional.
  2. The report is not mental-health advice. It does not assess, diagnose, or treat any mental-health condition. If you are experiencing distress, please contact a licensed professional or a crisis line in your country.
  3. The report is not legal, financial, tax, investment, or career advice. Decisions in those areas remain your own responsibility and should be made with qualified counsel.
  4. The report is descriptive, not forward-looking. Where the report speaks about patterns of energy, rhythm, or tendency, those are reflective frames, not forecasts.

You agree not to use a NYXA report as the sole basis for any major life, health, legal, or financial decision.

§5 Account

The Service does not require account creation. Your email address functions as your access key; magic-link emails restore access on a new device. We do not maintain a password.

You are responsible for keeping your email account secure. Sharing your magic link gives whoever clicks it access to your report.

If you share your report link with another person, you are responsible for any data you reveal by doing so. The link is not access-controlled beyond knowledge of the URL.

§6 Pricing and payment

The report is a one-time purchase at the price displayed at checkout, which includes any applicable sales tax / VAT / GST.

Payments are processed by a third-party payment processor acting as Merchant of Record. Our payment processor is the legal seller for tax purposes and issues the receipt / invoice. We do not see or store your full card number.

Our payment processor's own terms of service apply to the payment step in addition to these Terms.

Currency presentation may differ by country. The actual charge is in U.S. Dollars unless your card issuer converts; any conversion fee is set by your issuer, not by us or by our payment processor.

§7 Access duration

Each purchased report carries 6 months of access from the date of payment. After 6 months, access to that report ends automatically and no renewal is offered — you can purchase the report again at any time to restore access.

  • The 6-month window is per-report. If you purchase a second report later, its 6-month window starts on its own payment date.
  • We retain the entitlement record for 3 years from your last access, then minimize it for tax records (see Privacy Policy §5).
  • If we change processors (e.g., migrate from one payment processor to another payment platform, or change Upstash region) during your 6-month access window, we will preserve your access; the entitlement record migrates.
  • If the Service is permanently discontinued during an active access window, we will give at least 60 days notice by email and a downloadable PDF export of your paid report.

§8 Acceptable use

You may not:

  • Resell, sublicense, or republish your report text, in whole or in substantial part. Personal sharing of the share card or individual quotes is fine and explicitly encouraged.
  • Use automated means to scrape reports, bypass paywall, or forge webhook events.
  • Submit false birth data on someone else's behalf to obtain a report you intend to use against that person's interest (e.g., workplace screening, dating-app vetting).
  • Interfere with the Service's security, rate limits, or other abuse-prevention measures.

We may suspend or terminate your access for a material breach, giving notice where possible.

§9 Intellectual property

The Service, including the report text, archetype designs, card illustrations, the NYXA visual system, and the underlying codebase, is owned by Hong Chae-eun and protected by copyright, trademark, and related rights.

You receive a personal, non-transferable, non-exclusive licence to access and read your purchased report. No further licence is granted.

The Korean four-pillar (BaZi) framework itself is public-domain classical knowledge; our particular expression of it is protected.

§10 Refunds

The refund eligibility and procedure are governed by the separate Refund Policy, incorporated into these Terms by reference. Summary:

  • 7-day unconditional refund from the order date.
  • After 7 days: refund only if you have not opened the report (no recorded /full-report access).
  • Refund decisions are NYXA's; refund execution is by our payment processor.

§11 Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to the Service is limited to the amount you paid for the report in the 12 months preceding the claim.

We are not liable for:

  • Indirect, incidental, consequential, special, or exemplary damages (e.g., lost profits, lost data unrelated to your report, business interruption).
  • Decisions you made on the basis of the report — see §4 disclaimer.

This clause does not limit liability that cannot be limited under applicable consumer-protection law, including but not limited to your statutory rights under California Civil Code §1668, EU Directive 2011/83/EU (Consumer Rights), and 대한민국 약관규제법 제7조 (책임배제·제한 금지) — those rights survive these Terms.

§12 Indemnity

You agree to indemnify and hold harmless NYXA from claims arising from (a) your violation of these Terms or applicable law, or (b) your unauthorized use of someone else's birth data through the Service. This indemnity does not apply to claims caused by our own negligence or willful misconduct.

§13 Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws principles. Mandatory consumer-protection law of your country of residence applies in addition to the extent it provides protections that exceed Korean law (per Rome I Reg. (EC) 593/2008 for EU residents, Civil Code of California §1646.5 for California residents, etc.).

Dispute resolution path:

  1. First contact support@trynyxa.com. We will reply within 5 business days and attempt to resolve the dispute informally.
  2. If unresolved after 30 days, you may pursue formal action.
  3. EU/EEA residents may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
  4. Korean residents may file with the 한국소비자원 (kca.go.kr) or 전자거래분쟁조정위원회 (ecmc.or.kr).
  5. U.S. residents retain the right to file in small-claims court of competent jurisdiction. No mandatory arbitration clause and no class-action waiver are imposed in this v1.
  6. Other jurisdictions — the courts of the Republic of Korea are the venue of last resort, without prejudice to mandatory local rules.

§14 Changes to these Terms

We may update these Terms. Material changes bump the policy_version. We notify by email (to your report email) at least 30 days before the change takes effect for material changes, except where the change is required by law to take effect sooner. Minor wording / clarity edits may take effect immediately.

You may close your account (request deletion under Privacy Policy §8) before the effective date if you disagree with the change.

§15 Severability and assignment

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. We may assign these Terms in connection with a business transfer (with notice); you may not assign without our written consent.
